Gebeurt het u ook wel eens dat u een aankoop doet of een offerte ondertekent waar u nadien niet meer zo zeker van bent?

Het is een vaak voorkomend misverstand dat wanneer u een product koopt in een winkel, u het recht zou hebben om dit product terug te brengen en uw geld terug te krijgen. Doet u een aankoop in de winkel, dan is deze definitief en kunt u hier wettelijk gezien niet meer onderuit.

Dit neemt niet weg dat verkopers, uit commerciële overwegingen, toch soms overgaan tot terugbetaling (dikwijls in de vorm van een tegoedbon) of zich verbinden tot terugbetaling binnen een bepaalde periode op vertoon van het kassaticket.

Toch zijn er ook een aantal gevallen waarin u wettelijk gezien wel het recht hebt af te zien van uw aankoop. U beschikt dan als consument over een zogenaamd herroepingsrecht.

Dit is onder meer het geval bij aankopen via internet.

U koopt schoenen in een webwinkel? Dan beschikt u over een bedenktijd van 14 dagen. U kan de schoenen uitproberen en, desgevallend, terugsturen. Dit is wettelijk zo voorzien.

De periode van 14 dagen neemt een aanvang bij de ontvangst van het goed.

Opgelet, u mag het goed enkel testen (m.a.w. kort gebruiken, enkel om het uit te proberen). U mag dus enkele stappen zetten met de schoenen, maar geen avondje uitgaan. Uiteraard mag u het product ook niet beschadigen.

Niet enkel bij online aankopen, maar ook bij andere ‘aankopen op afstand’ geniet u als consument van het herroepingsrecht.

Het is u misschien al overkomen dat een verkoper u telefonisch een aanbod doet, te mooi om waar te zijn. Wanneer u het product vervolgens thuis ontvangt, heeft u toch twijfels en wenst u af te zien van de aankoop. Ook dat kan, via het herroepingsrecht.

Hoe kan ik precies gebruik maken van mijn herroepingsrecht? Heel eenvoudig. Binnen de 14 dagen te rekenen vanaf de ontvangst van de goederen dient u schriftelijk aan te geven dat u de overeenkomst wenst te herroepen. Gebruik klaar en duidelijk deze term of maak gebruik van het modelformulier. U hoeft geen specifieke reden aan te geven om te herroepen. Om achteraf bewijsproblemen te vermijden doet u dit via een aangetekend schrijven.

De verkoper moet de consument informeren over het bestaan van het herroepingsrecht en hoe het kan uitgeoefend worden, nog voordat de overeenkomst tot stand is gekomen. Doet de verkoper dit niet, dan wordt de termijn om gebruik te maken van het herroepingsrecht automatisch verlengd met 12 maanden.

Hoe en wanneer stuur ik de goederen terug? U doet dit meteen (zeker binnen een termijn van 14 dagen) nadat u de overeenkomst herroepen heeft. De wet voorziet dat de kosten voor het terugsturen ten laste vallen van de consument. Vaak echter neemt de verkoper deze (grotendeels) voor zijn rekening, maar u kan dit dus niet eisen.

Kan de verkoper mij toch kosten aanrekenen als ik beroep doe op het herroepingsrecht? Neen. De verkoper moet alle ontvangen betalingen terugbetalen en dit binnen 14 dagen nadat deze kennis heeft genomen van de beslissing tot herroeping. Wel kan de verkoper wachten met de terugbetaling totdat hij alle goederen heeft teruggekregen, of totdat u heeft aangetoond dat u de goederen heeft teruggezonden, naar gelang welk tijdstip eerst valt.

Uitzonderingen? Geen regel zonder uitzondering. In bepaalde gevallen kan u geen gebruik maken van het herroepingsrecht, zelfs al is de overeenkomst tot stand gekomen vanop afstand. Zo kunt u geen gebruik maken van het herroepingsrecht voor goederen op maat (fotoboeken), verzegelde goederen (software), goederen die u aankoopt op een openbare veiling, boekingen van een vlucht, hotel of auto, goederen die snel bederven, enz… Voor gas, water en elektriciteit geldt een bijzondere regeling en werden specifieke afspraken gemaakt met de sector.
