Met de Wet van 9 maart 2014 werd de verkeerswetgeving verstrengd. De meeste bepalingen van de wet traden in werking op 1 januari 2015.

Graag overlopen wij met u enkele opvallende wijzigingen;

Recidivisten hard aangepakt

Opvallend is dat hardleerse overtreders, de zogenaamde recidivisten, vanaf 1 januari 2015 harder worden aangepakt.

Wanneer een bestuurder, binnen de 3 jaar na een veroordeling voor een zware overtreding, opnieuw een zware overtreding begaat (enkelvoudige recidive), zal de politierechter hem veroordelen tot een rijverbod van minstens 3 maanden. Bovendien zal hij verplicht worden om de 4 herstelexamens met succes af te leggen (theoretisch examen, praktisch examen, geneeskundige en psychologische proef).

Bij tweevoudige recidive binnen de periode van 3 jaar, wordt het rijverbod gebracht op minstens 6 maanden. Bij drievoudige recidive krijg je minstens 9 maanden rijverbod.

Welke zijn de zware overtredingen die beoogd worden? vluchtmisdrijf, zware snelheidsovertredingen, rijden zonder rijbewijs, overtredingen van de 4de graad, ernstige alcoholintoxicatie, dronkenschap, gebruik van een radardetector en rijden zonder rijbewijs.

Opgelet, niet enkel een herhaling van eenzelfde soort overtreding wordt geviseerd, bijvoorbeeld intoxicatie na intoxicatie. Het principe is van toepassing in geval van herhaling van eender welke zware overtreding. Een voorbeeld ter verduidelijking: werd je vorig jaar veroordeeld voor ernstige alcoholintoxicatie, en word je nu vervolgd voor een aanzienlijke snelheidsovertreding, dan zal het nieuwe principe van toepassing zijnen wordt dit gezien als een geval van recidive.

Professionele bestuurders en alcohol

Vanaf 1 januari 2015 werd voor professionele bestuurders van vrachtwagens, bussen, taxi’s, ambulances de intoxicatiedrempel verlaagd. Tijdens de uitoefening van hun beroep bedraagt de maximaal toegelaten alcoholconcentratie slechts 0,2 promille (= 0,09 mg/l uitgeademde alveolaire lucht).

Voor niet-professionele (gewone) bestuurders ligt de grens op 0,5 promille (0,22 mg/l uitgeademde alveolaire lucht).

Hangt er een geurtje?

Voortaan kan de politie bij een alcoholcontrole wettelijk gebruik maken van een “samplingtoestel”. Dit toestel detecteert de aanwezigheid van alcohol in de omgevingslucht. Het kan de politie helpen een eerste selectie te maken om de bestuurders eruit te pikken die ze vervolgens aan een echte ademtest zullen onderwerpen.

Politie trekt zelf rijbewijs in

Waar de politie voordien de toestemming diende te vragen aan de Procureur des Konings om een onmiddellijke intrekking te doen van een rijbewijs bij alcoholintoxicatie, dronkenschap of overdreven snelheid, is dit nu niet langer vereist. De politie kan dit op eigen houtje beslissen.

Glaasje te veel op? Meteen betalen!

De Wegverkeerswet werd aangepast zodat ook een onmiddellijke inning kan worden voorgesteld in geval van alcoholintoxicatie. Zo zullen buitenlandse bestuurders die onder invloed achter het stuur worden betrapt op Belgisch grondgebied hun straf niet langer ontlopen.

Trajectcontrole

Verder kreeg ook het principe van de trajectcontroles een duwtje in de rug. De camera’s die aan nummerplaatherkenning doen en die gebruikt worden voor trajectcontrole kregen een wettelijk kader.  Deze camera’s worden tevens ingezet om niet-verzekerde en niet-gekeurde voertuigen op te sporen.

Herroeping opschorting en uitstel

Tenslotte werd het herroepen van opschorting en uitstel eenvoudiger gemaakt.

Opschorting betekent dat de rechter oordeelt dat de feiten die u ten laste worden gelegd, bewezen zijn, maar dat hij zijn uitspraak van veroordeling voor een bepaalde proeftermijn opschort. De termijn, ook wel proeftermijn genoemd, kan afhankelijk van de feiten lopen van 1 tot 5 jaar. Anders gezegd, bij opschorting wordt u schuldig verklaard, maar krijgt u geen straf.

Uitstel betekent dat de rechter oordeelt dat de feiten die u ten laste worden gelegd, bewezen zijn, dat hij u ook een straf oplegt, maar dat de uitvoering van de straf voor een bepaalde termijn wordt uitgesteld. Deze proeftermijn kan, afhankelijk van de feiten, lopen van 1 jaar tot 5 jaar. Anders gezegd, bij uitstel van straf wordt u schuldig verklaard, u krijgt een straf, maar deze straf wordt niet uitgevoerd.

Aan deze gunstmaatregelen wordt een proefperiode gekoppeld. Voordien gebeurde de herroeping van deze gunstmaatregel (bijna) nooit.  Vanaf 1 januari 2015 is de herroeping steeds mogelijk van zodra er in de proefperiode een nieuwe verkeersinbreuk werd gepleegd.
